The short version

Green Mind helps you plan a Gulf Coast garden. It is a planning tool, not a professional advisory service. Gardening depends on weather, soil, and care we cannot see or control, so we cannot promise results — and our plant diagnosis is an automated suggestion that can be wrong. Read sections 7, 8 and 9 in particular; they are the ones that matter if something goes wrong.

1. Acceptance

Green Mind: Zone 9 (“GreenMind”) is operated by ConcordiaPax LLC (“Cpax”, “we”, “us”). By using GreenMind — other than to read these Terms — you agree to them. Your right to use GreenMind is personal to you and is not transferable. You are responsible for all use of your account and for keeping your password confidential.

We may change or discontinue any part of GreenMind, including its content, availability, and the equipment needed to use it.

2. Changes to these terms

We may change these Terms. When a change materially affects your rights or obligations, we will update the effective date above and notify account holders by email before the change takes effect. Other changes take effect when posted.

Continuing to use GreenMind after a change takes effect means you accept it. If you do not, stop using the service and delete your account.

3. What GreenMind is

GreenMind is a gardening and outdoor-living assistant for USDA Zone 9 households, serving Galveston County, Texas first. It provides:

a planting calendar and seasonal plan built around your ZIP code, garden goal, and available space;

—

weather-aware task suggestions and alerts;

—

plant-problem diagnosis from photographs you submit, produced by an automated model;

—

curated guidance, which is organic and environmentally responsible by policy;

—

optional referral to local service providers for work you request.

GreenMind is an information and planning tool. It is not a horticultural, agricultural, pest-control, medical, or veterinary advisory service, and using it does not create a professional relationship.

4. Your account

You must be at least 18 to create an account. GreenMind is not directed to children under 13 and we do not knowingly collect their information.

You are responsible for the accuracy of what you tell us. A planting plan built on the wrong ZIP code will be wrong, and that is not a defect in the service.

5. Equipment

You are responsible for the hardware, software, connectivity, and any charges needed to reach GreenMind.

6. How you may use it

You agree not to:

use GreenMind unlawfully, or in violation of any pesticide, herbicide, water-use, burn, or environmental regulation that applies to you;

—

upload photographs of property you do not own or occupy, or of other people, without permission;

—

upload anything unlawful, infringing, malicious, or deliberately misleading;

—

scrape or systematically extract our guidance, calendar data, or knowledge content, or use it to train a competing model;

—

resell or redistribute the guidance as your own service;

—

access another user’s account or data, probe the security of the service, or interfere with its operation.

We may suspend or close an account for conduct that violates this section.

7. Subscriptions

GreenMind does not currently offer a paid plan. If and when one is introduced, its price, billing period, renewal terms, and cancellation and refund policy will be disclosed before you pay, these Terms will be updated, and account holders will be notified under section 2.

8. Gardening guidance is not a guarantee

We cannot promise that following GreenMind’s guidance will produce any particular yield, harvest, germination, or plant survival. Crop failure and plant loss are ordinary risks of gardening and remain yours.

Gardening outcomes depend on weather, soil, water, seed and plant stock, timing, pests, and the care actually given — nearly all of which are outside our knowledge and entirely outside our control.

Our calendars, task suggestions, planting windows, and recommendations are general guidance based on regional patterns. They are not predictions and not professional advice. You decide what to plant, when, and how, and you are responsible for checking anything that matters to you against your own judgment and local conditions.

9. Plant diagnosis is automated and can be wrong

Never eat, apply, or administer anything on the basis of a GreenMind diagnosis alone.

Diagnosis from photographs is produced by an automated model. It is a suggestion, not an identification, and it can be confidently wrong — particularly with unusual conditions, poor photographs, plants from outside our region, or problems with more than one cause.

Do not rely on GreenMind to decide whether a plant is safe to eat, whether a plant or mushroom is toxic, or whether a substance is safe for people, pets, or livestock. For anything that could affect health or safety, consult a qualified professional — a county extension office, a licensed arborist or applicator, a physician, or a veterinarian.

10. Products and what you apply

Our guidance policy is organic and environmentally responsible first. We do not recommend restricted-use products or anything requiring an applicator’s license.

You are solely responsible for anything you apply to soil, plants, or property. The product’s own label is the legally controlling instruction and supersedes anything GreenMind says.

Comply with all applicable regulations, including restrictions on application near water, during wind, or before rain, and keep people, pets, and livestock clear as the label requires. We are not liable for damage to plants, soil, property, health, or the environment resulting from products you choose to apply.

11. Local service providers

GreenMind may connect you with independent local service providers for work you request. Those providers are not employees, agents, or partners of ConcordiaPax LLC. We do not perform the work, supervise it, or warrant it.

Any agreement for services is between you and the provider. Verify their licensing, insurance, and suitability yourself. We are not liable for their acts, omissions, work quality, pricing, or conduct.

12. Your content, and the permission you give us

“Your Content” means the photographs, journal entries, notes, and garden details you submit. You keep ownership of it.

You grant ConcordiaPax LLC a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, and process Your Content in order to:

—

operate GreenMind and provide the service to you;

—

improve and train the gardening models that power GreenMind, including the diagnosis model, after direct identifiers — your name, email address, and phone number — have been removed;

—

produce aggregated or de-identified guidance and statistics that do not identify you.

This licence survives deletion of your account only as to material already incorporated into a trained model or an aggregate, which cannot practically be extracted. We do not sell Your Content and we do not license it to third parties as a dataset. Our Privacy Policy describes this in full.

You confirm you have the right to grant this licence for everything you submit.

13. Our content

GreenMind, its content, calendars, curated guidance, software, and brand are owned by ConcordiaPax LLC or its licensors. You get a personal, non-transferable, revocable licence to use them for your own gardening. Nothing here transfers ownership.

14. Third-party services

GreenMind relies on third-party hosting, database, email, and weather-data providers. Their availability and accuracy are outside our control. Weather data is a forecast, not a fact.

15. No warranties

GreenMind is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that GreenMind will be uninterrupted, secure, or error-free, or that its guidance, diagnoses, or data will be accurate or complete.

16. Limit of our liability

To the fullest extent permitted by law, ConcordiaPax LLC and its members, officers, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost yields, lost crops, lost data, property damage, or business interruption arising out of your use of GreenMind — whether in contract, tort, negligence, strict liability, or otherwise, and even if we were advised of the possibility.

Our total aggregate liability for all claims relating to GreenMind will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain exclusions or limits. Where that is so, they apply to the fullest extent permitted, and nothing here limits liability that cannot lawfully be limited.

17. Indemnification

You agree to indemnify and hold harmless ConcordiaPax LLC from claims, damages, losses, and reasonable legal fees arising out of your use of GreenMind, Your Content, your violation of these Terms, or your violation of any law or the rights of a third party.

18. Ending your use

You may stop using GreenMind at any time and delete your account from your account settings. We may suspend or end your access for violation of these Terms or if we discontinue the service. Sections 8 through 17, and any other provision that by its nature should survive, survive termination.

19. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and ConcordiaPax LLC consent to the exclusive jurisdiction and venue of the state and federal courts located in Galveston County, Texas.

20. General

If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and ConcordiaPax LLC regarding GreenMind. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
